These Terms and Conditions (“Terms”) govern your use of our dating app and related
services (“Service”). By accessing or using the Service, you agree to these Terms.
1. Eligibility
● You must be at least 18 years old or the age of majority in your jurisdiction,
whichever is greater.
● You must not be married.
● You must comply with all applicable laws in both the United States and your local
jurisdiction.
2. Global Compliance
You agree to abide by all laws, rules, and regulations applicable to your use of the
Service, including U.S. export laws, international sanctions, and all relevant local
regulations in your place of residence or access.
3. Arbitration & Class Action Waiver
All disputes, claims, or controversies arising out of or related to your use of the Service
will be resolved by binding arbitration in Orange County, California, USA, under the rules
of the American Arbitration Association.
You waive any right to participate in a class action, collective, or representative lawsuit.
4. Assumption of Risk
You acknowledge and assume all risks, including emotional, social, reputational, and
physical risks, arising from using the Service, including but not limited to interactions
with other users both online and offline.
5. Content Licensing & DMCA Safe Harbor
By posting content to the Service, you grant Evindari a worldwide, non-exclusive,
royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish,
translate, create derivative works from, distribute, publicly perform, and display such
content in connection with providing our Service.
Evindari complies with the Digital Millennium Copyright Act (DMCA). For takedown
requests, contact support@evindari.com.
6. User Conduct
You agree not to:
● Use the Service for any unlawful, fraudulent, or malicious purpose.
● Harass, exploit, or harm other users.
● Impersonate any individual or entity.
● Post misleading, obscene, offensive, or otherwise inappropriate content.
● Use automated scripts or bots to access, collect data from, or interact with the
Service.
● Violate the privacy or data rights of others.
7. Account Security
You are responsible for maintaining the confidentiality of your login credentials. You
agree to notify Evindari immediately of any unauthorized use of your account.
8. Termination
Evindari may suspend or terminate your account or access to the Service at any time,
with or without notice, for any reason, including breach of these Terms.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express
or implied, including but not limited to merchantability, fitness for a particular purpose,
accuracy, reliability, availability, or non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, Evindari shall not be liable for any indirect,
incidental, special, consequential, punitive, exemplary, or other damages resulting from
or relating to your use or inability to use the Service, regardless of the theory of liability
(contract, tort, negligence, strict liability, or otherwise).
11. Indemnification
You agree to indemnify, defend, and hold harmless Evindari, its affiliates, officers,
directors, employees, agents, and partners from and against any claims, damages,
obligations, losses, liabilities, costs, debt, or expenses (including attorney’s fees) arising
out of or related to your use of the Service, your violation of these Terms, or your
violation of any rights of another.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United
States without regard to conflict-of-law provisions.
You agree to submit to the exclusive jurisdiction of Orange County, California, USA for
the resolution of any disputes.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, such provision
shall be severed, and the remaining provisions will remain in full force and effect.
14. Changes to Terms
Evindari reserves the right to modify these Terms at any time. Updates will be posted
in-app and on our website. Continued use of the Service after such updates indicates
your consent to the new Terms.
